Terms
Deliveries and services provided by xDevelop GmbH are governed by the General Terms of Delivery issued by the Austrian Electrical and Electronics Industry Association (FEEI). For software, the same association's Software Terms take precedence.
Business customers
The FEEI terms apply to transactions between businesses. They cover, among other things, offers and formation of contract, prices, delivery and passing of risk, payment, retention of title, warranty and liability.

Deviating terms of the customer apply only if we agree to them in writing. The prices and dates in our written order confirmation are always decisive; the total shown in the business form is a non-binding calculation and does not constitute an offer.
The minimum order quantity for business customers is 25 units in total. Prices for business customers are net, plus VAT and shipping.
Private customers
The FEEI terms apply expressly between businesses only and do not apply to consumers. Statutory provisions apply to private customers, in particular the Austrian Consumer Protection Act and the Distance and Off-Premises Contracts Act.
Orders for single units are placed through Amazon. The contract of sale is then formed under Amazon's terms; shipping, payment, returns and the handling of warranty claims follow Amazon's order process.
For orders placed directly with us, consumers have a statutory right of withdrawal of 14 days from receipt of the goods. It does not apply to goods made to customer specification or clearly tailored to personal requirements — this includes customised devices and devices shipped with customer firmware.
Availability of meter data
Which readings the adapter can deliver is determined by the smart meter and the grid operator, and is outside our control. The meter key required for decryption is issued solely by the grid operator. Compatibility information reflects our current knowledge and does not constitute a warranty of particular characteristics.
Open-CPU devices
Devices in the Open-CPU edition are supplied without a non-disclosure or licence agreement. The warranty covers the hardware, not the functioning of firmware flashed by the customer.
Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with businesses is Salzburg. For consumers, the statutory places of jurisdiction apply.
